These Terms and Conditions ("Terms") govern your access to and use of the Faxio website at faxio.in ("Site" or "Platform"), operated by Faxio ("Company," "we," "us," or "our"). Faxio is a crowdfunding platform that lets people raise funds for medical, emergency, and other personal causes, and lets donors contribute to campaigns they choose to support. By accessing the Site, donating, or submitting a campaign, you agree to be bound by these Terms. If you do not agree, please do not use the Site.
1. Acceptance of Terms
By accessing or using the Site, you confirm that you are at least 18 years of age (or are using the Site with the involvement of a parent or guardian), have read and understood these Terms, and agree to be legally bound by them. If you are creating a campaign on behalf of a beneficiary, you represent that you have their consent or the authority to act on their behalf.
2. Use of the Platform
2.1 Permitted Use
You may use the Site to browse campaigns, make donations, and submit a campaign for review in accordance with our Campaign Guidelines.
2.2 Prohibited Conduct
You agree not to:
- Submit a campaign containing false, misleading, or fabricated information or documentation
- Use the Site in any way that violates applicable laws or regulations
- Attempt to gain unauthorized access to any part of the Site or its related systems
- Transmit any harmful, offensive, defamatory, or infringing content
- Use automated scripts, bots, or scrapers to collect data from the Site
- Impersonate any person or entity or misrepresent your affiliation with a beneficiary
- Solicit donations for a cause you do not have the right to raise funds for
- Interfere with the proper operation of the Site or its servers
3. Campaign Submission and Review
Anyone may submit a campaign for consideration via /campaigns/create. Submitting a campaign does not guarantee that it will be published. Every submission is reviewed and verified before it goes live, and not all submitted campaigns are approved. Full submission requirements, eligible causes, and the review process are described in our Campaign Guidelines.
4. Donations
Donations made through the Site are subject to our Donation Terms and Refund Policy, which form part of these Terms. In this demo, checkout is a placeholder flow and no real payment gateway is connected — no actual funds are transferred.
5. Intellectual Property
All Site content — including text, graphics, logos, design, and code — is the property of Faxio or its licensors and is protected by copyright, trademark, and other intellectual property laws.
By submitting a campaign, you grant Faxio a non-exclusive, royalty-free license to display the story, images, and updates you provide for the purpose of operating and promoting the campaign on the Platform. You retain ownership of your content and may request its removal, subject to our record-keeping obligations.
6. Disclaimers
6.1 No Warranty
THE SITE AND ITS CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
6.2 Campaign Accuracy
While campaigns undergo a review process before publication, Faxio acts as a platform connecting donors and campaign creators and cannot independently verify every fact stated in a campaign story. We encourage donors to review campaign details and give at their own discretion.
7. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, FAXIO AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE, A DONATION MADE THROUGH THE SITE, OR THESE TERMS.
8. Third-Party Links and Services
The Site may contain links to third-party websites or services not operated by us, including payment processors. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party sites.
9. Indemnification
You agree to defend, indemnify, and hold harmless Faxio and its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including attorneys' fees) arising from: (a) your use of the Site, (b) your violation of these Terms, or (c) false or fraudulent information submitted in connection with a campaign.
10. Governing Law and Dispute Resolution
This is placeholder text. In a live deployment, this section would specify the governing law and dispute resolution process applicable to Faxio's registered operating entity and jurisdiction, which has not yet been finalized for this demo.
11. Termination
We reserve the right to suspend or remove a campaign, or restrict a user's access to the Site, at our sole discretion, for conduct that we believe violates these Terms, our Campaign Guidelines, or is harmful to donors, beneficiaries, or the Platform.
12. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
13. Entire Agreement
These Terms, together with our Privacy Policy, Donation Terms, Refund Policy, and Campaign Guidelines, constitute the entire agreement between you and Faxiowith respect to your use of the Site.
14. Changes to Terms
We may revise these Terms at any time by updating this page. The "Last updated" date will reflect the most recent revision. Your continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.
